Divorce marks the legal end of your marriage. However, your divorce will not settle issues such as the parenting arrangements for your children, child support, the division of the property of your marriage, nor spousal maintenance. These issues are dealt with separately.
To have a divorce order granted, a married couple must have been separated for at least one year prior to the time an application for divorce is filed and must satisfy the court that the relationship has broken down permanently.
Where there are children of the marriage under the age of eighteen years, the court must also be satisfied that arrangements for their future care are satisfactory. The Court might not grant a divorce unless it is satisfied that appropriate arrangements have been made in respect of the care of children.
An Application for a Divorce can be made jointly or by one of the parties to the marriage.
